A Section 24G Rectification Process is required for the unlawful commencement of listed activities in terms of the Environment Conservation Act (ECA), 1989 (Act No. 73 of 1989), and the National Environmental Management Act (NEMA), 1998 (Act No. 107 of 1998) for the upgrade and expansion of the Shell Bergvliet Service Station, Western Cape, South Africa.

The initial site operations commenced in 1974 which is prior to the promulgation of ECA and NEMA. The site therefore did not require an environmental authorisation at inception.

In 2013, the site underwent an upgrade and expansion of operational infrastructure in excess of 80m3 which would require an application for environmental authorisation in terms of Activity 42 of the NEMA Environmental Impact Assessment Regulations Listing Notice 1, 2010 (GN R 544 of 2010), that stated:

  • “Activity 42: The expansion of facilities for the storage, or storage and handling, of a dangerous good, where the capacity of such storage facility will be expanded by more than 80 cubic metres or more.”

SLR Consulting (South Africa) (Pty) Ltd (SLR) has been appointed by Shell as the independent Environmental Assessment Practitioner (EAP) to undertake a Section 24G rectification process for the project in respect of the unlawful commencement of the listed activities mentioned above.

Status

Notice is hereby given, in terms of NEMA and the Environmental Impact Assessment (EIA) Regulations, 2014 (as amended), that the draft Section 24G Report prepared for the aforementioned project has been made available for a 21-day public and authority review and comment period from 5 June to 1 July 2024.
