Section 24G Application for the Rectification of the Unlawful Upgrade and Expansion of the Shell Zoo Park Service Station, Western Cape, South Africa

A Section 24G Rectification Process is required for the unlawful commencement of listed activities in terms of the Environment Conservation Act (ECA), 1989 (Act No. 73 of 1989), and the National Environmental Management Act (NEMA), 1998 (Act No. 107 of 1998) for the upgrade and expansion of the Shell Zoo Park Service Station, Western Cape, South Africa.

The initial site operations commenced in 1976 which is prior to the promulgation of the Environment Conservation Act, (ECA), 1989 (No. 73 of 1989) and the National Environmental Management Act, (NEMA), 1998 (No. 107 of 1998). The site therefore did not require an environmental authorisation at inception.

In 2016, the site underwent an upgrade and expansion of operational infrastructure by 92m3 and which required an application for environmental authorisation in terms of Activity 1c of Schedule 1 in terms of GNR1182 of 5 September 1997, as amended, in terms of section 21 of the Environment Conservation Act 73 of 1989, that stated:

• “Activity 51: The expansion and related operation of facilities for the storage, or storage and handling, of a dangerous good, where the capacity of such storage facility will be expanded by more than 80 cubic metres.”

SLR Consulting (South Africa) (Pty) Ltd (SLR) has been appointed by Shell as the independent Environmental Assessment Practitioner (EAP) to undertake a Section 24G rectification process for the project in respect of the unlawful commencement of the listed activities mentioned above.

Status

Notice is hereby given, in terms of NEMA and the Environmental Impact Assessment (EIA) Regulations, 2014 (as amended), that the draft Section 24G Report prepared for the aforementioned project has been made available for a 21-day public and authority review and comment period from 5 June to 1 July 2024.
