On October 14, 2019 the California State Water Resources Control Board released results from their first phase of their state-wide investigation into the presence of PFAS in groundwater. This initial phase of testing included almost 600 drinking water supply wells, primarily those in the vicinity of airports and municipal solid waste landfills, and in wells where these contaminants had been observed previously.

SLR’s Kellye Larsen-Dundon, Associate Scientist was elected to serve another year as vice chair for the Oregon Chapter of Air & Waste Management Association (AWMA). Kellye has been in this role since 2017 and has also served as chapter secretary from 2013 to 2017. Kellye began her career over 7 years ago and specializes in transportation noise analysis and industrial noise monitoring. She has measured existing noise levels and counted traffic for proposed highway projects in the state of Oregon, as well as analyzing noise mitigation techniques, such as barriers of different heights to optimize noise reduction and cost effectiveness. She specializes in regulatory compliance, permitting, and greenhouse gas emissions.

In March, a bipartisan group of senators introduced legislation that would classify all PFAS (Per- and Polyfluoroalkyl Substances) as “hazardous substances” under the Comprehensive Emergency Response, Compensation, and Liability Act (CERCLA), often referred to as Superfund. If this bill passes and is signed into law, cleanups of these chemicals would be eligible for CERCLA cleanup funds and cost recovery actions under that law. The bill was introduced following the EPA’s issuance of their PFAS Action Plan, which was met with a mixed response, including skepticism from states who have indicated that some of the steps highlighted in the action plan should be taken more quickly – such as the change outlined in this recent legislation.

Does reluctance in the waste sector to manage recyclables price risk presents opportunities for the insurance sector? Over 6 million tonnes of recyclables (e.g. paper, card, metals, plastics, glass) are collected annually from 23 million households in England and the volumes are expected to increase further in the future. The responsibility for providing household recyclables collection service in England sits with c.320 local authorities, of which over 170 have contracts with private waste management companies for the provision of collection services.

The State of Victoria Department of Environment, Land, Water & Planning (DELWP) have recently released their ‘Better Apartment Design Standards’ (BADS) which includes internal noise requirements for apartment buildings. These requirements are for properties within stated catchment areas from industrial, road and rail land uses. This has the potential to impact over 400,000 land parcels within Greater Melbourne. SLR have developed the tools to quickly and easily support our clients in screening sites for possible noise implications. This is to help understand the potential cost impacts due to noise abatement during early costing exercises on a development site. Her expertise includes preparing new, renewal and modification NPDES discharge permit applications, CWA 316(b) cooling water intake support, aquatic bio-assessments, whole effluent toxicity (WET) and aquatic toxicity, water quality-based effluent limit derivation, and site-specific criteria development. Much of the comment appears to be raising the potential for concern, pushing those developing projects to seek additional advice that in reality may well be unnecessary. Our perspective is that if you were already pro-actively applying the old EIA Regulations to the specific advantage of your project, then the new regulations change little.
