De Beers Consolidated Mines Limited: Proposed Prospecting in Offshore Sea Concession 6C, West Coast
De Beers has submitted an application for a Prospecting Right (DMR Ref No. NC30/5/1/1/2(12189PR)) over Sea Concession 6C off the West Coast of South Africa. The proposed prospecting activities would be conducted in a phased approach and would entail: (i) regional scale geophysical surveys (Phase I) and (ii) high resolution geophysical surveys and exploration sampling (Phase II) over the concession area. SLR has been appointed to undertake the required NEMA Basic Assessment process.
On 28 February 2019, De Beers received the EA dated and issued by the Department of Mineral Resources (DMR) on 4 February 2019 for the above-mentioned project in terms of the National Environmental Management Act, 1998 (No. 107 of 1998), as amended, and the EIA Regulations 2014 (Government Notice No. R982 of 4 December 2014), as amended. Please note that despite the date of issue of the EA being 4 February 2019, it was only received by De Beers on 28 February 2019. It was confirmed by the DMR that this notification must thus be sent within 14 days of the date of receipt of the EA and not from the date the EA was issued.
A copy of the Environmental Authorisation has been made available below and outlines, amongst others, the decision, the activities authorised, conditions of authorisation, reasons for the decision and the appeal process in terms of the National Appeals Regulations, 2014 (as amended).
Your attention is drawn to your right to lodge a formal appeal with the Minister of Environmental Affairs. An appellant must, within twenty (20) days from the date that the notification of the decision was sent to the registered Interested and Affected Parties (I&APs) (i.e. 20 days from 14 March 2019):
- Submit an appeal in accordance with Regulation 4 of the National Appeal Regulations 2014 (as amended) to the Minister of Environmental Affairs; and
- Submit a copy of the appeal to the holder of the decision (De Beers), registered I&APs, any Organs of State with interest in this matter and the competent authority that issued the decision (i.e. DMR).
